The Center for Freethought Equality (CFE) Congressional Scorecard indicates legislation it tracked as being of great importance to humanists. Members are rated on a combination of co-sponsorships, floor votes, and Congressional Freethought Caucus (CFC) membership.

Religious Freedom/Combating Religious Privilege

H.Res. 356: National Day of Reason Resolution

We are free to ascribe to a religion or belief. Likewise, we are free from being dominated by a religion or belief. By cultivating a society with a clear distinction between church and state, we affirm the roles that science, critical thinking, and reason take to help stimulate proper solutions to social issues. This bill designates May 4th to be a “National Day of Reason”..

H.R. 2725: Do No Harm Act 2023

This bill would establish exceptions to the Religious Freedom Restoration Act of 1993’s (RFRA) applicability to laws that protect against discrimination or promote equal opportunity, such as the Civil Rights Act of 1964, and laws that require employers to provide compensation or benefits, protect against child labor or exploitation, or provide healthcare coverage. This bill is important for the prevention of RFRA’s use to legally discriminate on the basis of religious belief.

S. 1206: Do No Harm Act of 2023

H.R. 6302: Health Share Transparency Act of 2023

Healthcare sharing ministries are highly unregulated cost-sharing organizations that masquerade as health insurance. Commonly associated with evangelical Christian beliefs, these risk-pooling groups are open to people who share religious or ethical beliefs and have wide discretion to deny claims based on the moral or religious beliefs of their organizers. This bill would help put a stop to deceptive practices of health care sharing ministries by holding them accountable and requiring certain disclosures to current and prospective enrollees.

H.R. 4893: Scientific Integrity Act of 2023

While scientific research may never be truly objective, it certainly should be conducted and shared free from political interference. This bill would require federal agencies that fund or direct public science to establish and maintain clear scientific integrity principles, formalize these policies and strengthen them with the force of law, and hold scientists to high standards while guaranteeing their rights and protections under the law.

Judiciary Reform

H.R. 926: Supreme Court Ethics, Recusal, and Transparency Act of 2023

This bill would help ensure fairness and transparency in the highest court by establishing a code of conduct for Supreme Court justice and federal judges, instituting gift, reimbursement, income, and amicus disclosure requirements, requiring recusal under specified circumstances, imposing ‘duties to know and notify’, and establishing review panels for consideration of motions to disqualify, among other changes.

H.R. 3422: Judiciary Act of 2023

Historically, the number of seats on the Supreme Court has been adjusted seven times over the course of our nation’s history; there is also no constitutional mandate on the number of justices on the high court. The Judiciary Act simply increases the number of SCOTUS seats from nine to thirteen, accounting for the thirteen federal circuit courts.

H.R. 8830: High Court Gift Ban Act

The American public has recently become widely aware of Supreme Court Justices enjoying the receipt of gifts - such as luxury items and lavish vacations -  amounting to millions of dollars of unreported offerings. Congress must pass legislation curbing the bribery and corruption rampant in the Court. This legislation would instill certain caps on gifts justices receive, and bring the Supreme Court in line with similar Congressional and federal ethical standards.

Reproductive Health and Rights

H.R. 12: Women’s Health Protection Act of 2023

Abortion is an essential right. This bill would give health care providers the statutory right to provide abortion services by prohibiting governmental restrictions. Essentially codifying Roe v. Wade, the bill asserts providers are not required to conduct unnecessary medical procedures, provide inaccurate medical information, and prohibits governing bodies from stopping providers from offering telemedicine services or prescribing certain drugs related to abortion, among other important mandates.

S. 701: Women’s Health Protection Act of 2023

H.R. 4303: Abortion Justice Act of 2023

The Abortion Justice Act of 2023 is an important and comprehensive piece of legislation. This bill makes reproductive healthcare - including abortions and miscarriage care - a fundamental right, prohibits all levels of government from impeding that right, requires federally funded health care providers to offer patients all medically appropriate reproductive care, requires public and private health insurance plans to cover abortion services, prohibits immigration enforcement actions within 2,000 feet of any health care facility, and establishes a grant program to increase access to abortion services.

H.R. 1723: Abortion is Healthcare Everywhere Act of 2023

This bill would repeal the Helms Amendment: language in current law that prohibits certain foreign assistance funds from being used to pay for comprehensive reproductive health care services, including abortion services, abroad. Everyone, everywhere – especially those who are most marginalized and need family planning services – should be able to obtain a safe abortion and have the resources they need to access comprehensive reproductive health care.

H.R. 782: Ensuring Women’s Right to Reproductive Freedom Act of 2023

Pregnant people should not have to jump through hoops and have their right to travel impeded when obtaining lawful and essential health care. This bill would prohibit infringing on a person’s right to travel to another state to obtain an abortion, and protect any person, entity, or healthcare provider that assists them in doing so. The bill would additionally implement avenues for legal protection and enforcement of directives in this legislation.

S. 4223: Access to Birth Control Act

Access to contraception is an essential component of equitable healthcare. This bill would require pharmacies, as part of their normal practice, to provide customers with FDA-approved contraceptive medication in a manner that is informative and efficient. The bill prohibits the pharmacy’s employees from intimidating, threatening, and harassing a customer for their request to obtain contraception, and prohibits employees from interfering with, misrepresenting, and breaching confidentiality as it relates to a customer’s access to the medication.

LGBTQIA+ Equity

H.R. 15: Equality Act of 2023

This bill would prohibit religiously-motivated discrimination and codify protections for members of the LGBTQIA+ community by prohibiting discrimination and segregation on the basis of sex, sexual orientation, and gender identity in public accommodation, allowing the Department of Justice to intervene in related equal protections actions, and prohibiting denying a person the ability to utilize a shared facility, such as a restroom, that is in accordance with the person’s gender identity.

S. 5: Equality Act of 2023

S.4629: Every Child Deserves a Family Act

This bill would bar discrimination based on sex, sexual orientation, gender identity, religion and marital status against families or children in taxpayer-funded child welfare services. It also provides extensive resources to states, tribes, and agencies to improve care and outcomes for LGBTQI+ foster children.

H.R. 734: Protection of Women and Girls in Sports Act of 2023

Banning transgender girls from sports deprives them of social and physical health benefits and hinders important development of collaboration and team building skills. This unnecessary and exclusionary measure would make it a violation under Title IX for recipients of federal financial assistance who maintain athletic programs or activities to allow transgender girls and women to participate in such programs in accordance with their gender identities.

CFE Position: We oppose this legislation. A “no” supports our position.

S. 613: Protection of Women and Girls in Sports Act of 2023

Racial Equity

H.R. 40: Commission to Study and Develop Reparation Proposals for African Americans Act

The effects of the trans-Atlantic slave trade and the legal codification of enslavement have persisted through the centuries. The very foundation of this country denied the humanity of descendants of enslaved Africans, which has led to inequities centuries in the making: This bill would establish an expert reparations commission tasked with studying the legacy of slavery and the ways the failure to address its historical and ongoing harms have entrenched racial disparities in our country. The commission would also report to Congress its findings and recommendations, which may include revisions to federal laws, a scope of restitution, and ways to counteract slavery’s ongoing ill-effects.

S. 40: Commission to Study and Develop Reparation Proposals for African Americans Act

H.R.8525: George Floyd Justice in Policing Act of 2024

For too long, law enforcement has targeted black and brown communities, and it has often led to unjust death. Law enforcement must be reformed and held accountable for their actions in order to optimize the safety and well being of our communities. Among a plethora of necessary corrections, this bill would prohibit racial profiling, require officers to use body cameras, authorize a national task force for law enforcement oversight and establish a National Police Misconduct Registry.

Democracy

H.R. 11: Freedom to Vote Act

Millions of Americans are living in states that have severely restricted their voting rights. Voter disenfranchisement and election administration changes based on lies cannot be allowed to threaten our democracy any longer. This comprehensive legislation contains provisions that would improve election administration, election security, redistricting, and campaign finance rules, as well as establish a new Office of State Democracy Promotion. The legislation would protect voting rights by requiring automatic voter registration, increasing voting access for people with disabilities, and lowering wait times at the polls.

D.C. residents are prohibited from having Congressional representatives with full voting powers, and are required to pay taxes just like everyone else in the United States. Even with a municipal government present, much of D.C. 's affairs are governed by Congress. Washington residents deserve equal representation. This bill would grant Washington statehood and establish for the new state the elections of one representative and two senators with equal powers to other members of Congress.

S.J.Res. 4: A joint resolution removing the deadline for the ratification of the Equal Rights Amendment

S. 4973: No Kings Act

No person is above the law -  including the President. The Supreme Court established in its devastating ruling that a President is immune for actions taken while in office, allowing the President to sidestep constitutional checks and balances. Our democracy deserves a President that is held to the same lawful standards as its citizens. The No Kings Act would repeal the Supreme Court decisions granting presidential immunity and hold the President legally accountable for their actions.

H.Res.529: Relating to the resolution (H. Res. 503) impeaching Joseph R. Biden, Jr., President of the United States, for high crimes and misdemeanors.

After a performative attempt to impeach President Biden, this resolution was passed in the House of Representatives. If this resolution were to pass in the Senate, it would impeach President Biden for his alleged high crimes and misdemeanors following his perceived lack of control handling the southern border.

Education

H.R. 3583: Real Education and Access for Healthy Youth Act

Comprehensive sex education provides youth with crucial information about physical and sexual health practices and the navigation of healthy relationships. This bill would establish grants to support sex education and sexual health services for young people, require the recipients of such grants to comply with certain nondiscrimination requirements, and help train education professionals to effectively teach, and otherwise support, sex education, among other stipulations.

S. 1697: Real Education and Access for Healthy Youth Act

H.R. 5: Parents Bill of Rights Act

This measure has been touted to require public schools to allow parents to review and consent to certain materials and activities, and determine certain funding be based on that requirement. In reality, this bill is unnecessary, divisive, burdensome, and insulting to trained educators who already work hard to collaborate with parents. If passed, the measure would pave the way for further censorship including book and curriculum bans, impose redundant mandates, and inflict financial burdens on already underfunded schools.

Gun Violence

H.R. 715: Bipartisan Background Checks Act of 2023

From tragedy to tragedy, the majority of Americans understand that gun violence in America is out of control and needs to be addressed. This bill would prohibit a firearm transfer between private parties unless a licensed gun dealer, manufacturer, or importer first takes possession of the firearm to conduct a background check, except in specified circumstances.

H.R. 698: Assault Weapons Ban of 2023 Act

Assault weapons have no place in advancing and sustaining a safe democracy. Semiautomatic assault weapons  and large capacity ammunition feeding devices, are weapons of war and have been used to inflict serious and fatal harm. Among other provisions, this bill would prohibit the manufacture, purchase and sale of such weapons, with certain exceptions.
